Protective Measures
At Melius Family Law, we understand that domestic abuse and violence can happen to anyone. If you or someone you know is experiencing abuse, it’s important to know that there are protective measures available to help you stay safe.
Those protective measures include:
- Non-molestation order: an injunction that prohibits someone from using or threatening violence, intimidating, harassing, or pestering you. It can also prevent them from communicating with you, or coming within a certain distance of you or your home.
- Occupation order: an injunction that regulates who can live in a property, and can also exclude someone from the property altogether. It can be used, for example, to help you stay in your home to the exclusion of someone you feel threatened by.
- Restraining order: an order made by a criminal court, which can prevent someone from doing certain things, such as contacting you, approaching you, or going to certain places.
- Harassment warning: a warning given by the police to someone who has been harassing or intimidating you. It is not legally binding, but if the warning is ignored, it can be used as evidence in court.
